Welcome to Salty Clouds! We're so happy you're here. This website (saltyclouds.com) is owned and operated by Salty Clouds Pty Ltd ("we", "us", "our").

By browsing our site, creating an account, or placing an order, you agree to these Terms & Conditions (along with our Privacy Policy and Returns Policy). If you don't agree, please don't use our site.

We may update these Terms from time to time - we'll post the new version here, and your continued use means you accept the changes.

 

1. Important: Your Rights Under Australian Consumer Law (ACL) and New Zealand Consumer Guarantees Act (CGA)

Our jewellery comes with guarantees that cannot be excluded under the Australian Consumer Law (ACL).

You are entitled to:

  • A replacement or refund for a major failure (and compensation for any other reasonably foreseeable loss or damage).
  • Have the piece repaired or replaced if it fails to be of acceptable quality and the failure isn't major.

If you are purchasing from New Zealand, you may also have rights under the New Zealand Consumer Guarantees Act.

2. Who Can Shop With Us

You must be at least 18 years old (or have parental consent) to place an order. By shopping, you confirm you're legally able to enter a contract.

 

3. Ordering & Acceptance

  • All orders are an offer to buy -  we’ll email confirmation once we accept (that's when the contract forms).
  • We can refuse or cancel any order (e.g. if out of stock, pricing error, or suspected fraud) and will refund you straight away if we do.
  • Photos are for illustration and slight colour variations can happen due to screens and the PVD gold-plating process as most of our jewellery is hand made (this is normal and not a fault).
     

4. Prices & Payment

  • All prices are shown in AUD and are correct at checkout, however we reserve the right to correct any errors.
  • We accept Shopify Payments which includes common payment methods. Payment is taken at checkout.
  • Promotions/discounts have their own rules (check the offer - e.g. "buy two get one free" usually once per order, biggest discount applies if multiple codes).
     

5. Delivery

  • We ship Australia-wide and to selected international destinations, including New Zealand. Times are estimates only and delays can happen.
  • Risk passes to you once delivered; title passes when we receive full payment.
  • Free shipping thresholds and rates are shown at checkout.
  • International orders may be subject to local taxes or duties. However, orders to New Zealand under NZD $1,000 are generally not subject to additional charges on delivery.
     

6. Change-of-Mind Returns & Faults

Please see our separate Returns Policy for full details. We've made this simple, in short:

  • Change-of-mind: store credit on full-priced, unworn items (with conditions) within 30 days of delivery.
  • Faulty/damaged/wrong item: full refund or replacement - we cover everything.
     

7. Jewellery Care

Our jewellery is waterproof and tarnish-free, which means it’s effortlessly low-maintenance. However, we still recommend storing your pieces in a pouch or their original packaging when you’re not wearing them, and clean them regularly with a microfibre cloth to keep the shine and prevent any dirt build-up.


8. Warranties

We’re confident our jewellery will maintain its shine and colour, even with exposure to water, sweat, or humidity. That’s why we offer a lifetime colour warranty -  if your jewellery discolours under normal wearing conditions, we will replace it. We also provide a 1-year warranty for any faulty items. Please note, our warranties don’t cover:

  • Accidental damage, loss, or theft
  • Normal wear and tear, including minor damage (e.g. fading on high-friction areas after years of love)
  • Broken clasps, stretched chains, or lost pearls caused by impact or improper use
  • Damage from harsh chemicals (bleach, chlorine, acetone, strong perfumes, sanitiser)
  • Earring posts or ear wires (the part that goes through the ear)

 

9. Intellectual Property

Everything on the site (designs, photos, text) is ours or licensed to us. Feel free to browse, but no copying or commercial use without permission.

 

10. Your Content & Behaviour

If you post reviews, photos, or comments:

  • You grant us a free, perpetual license to use them (e.g. on socials - we'll always tag you if possible!).
  • Keep it kind, legal, and accurate - we can remove anything inappropriate.
  • You agree not to: use the site for anything illegal, upload viruses, harass anyone, or try to scam us.

 

11. Our Liability (The Serious Bit, Made Simple)

We’ll always do our best, but:

  • The site and products are provided "as is". We don’t guarantee uninterrupted access or that everything will be perfect.
  • To the fullest extent allowed by law and ACL rights, we’re not liable for indirect/consequential losses, or anything beyond our reasonable control.
  • Our total liability for any claim (except where prohibited by ACL) is limited to the price you paid for the item.
     

12. Privacy

We adore your trust. Your info is handled under our Privacy Policy and applicable privacy laws.

 

13. General Bits

  • These Terms are governed by the laws of New South Wales, Australia.
  • If any part is unenforceable, the rest still applies.
  • We can transfer our rights under these Terms. You can’t without our okay.
